Santa Barbara, CA (PRWEB) December 11, 2007 -- Employers have an obligation to follow the letter of the law when hiring associates. On November 7, 2007 The Department of Homeland Security published a new Form I-9 and a companion employer handbook. Recent case law illustrates the necessity for employers to provide training to its associates on how to prevent all forms of workplace harassment and discrimination. Such court rulings indicate employers' potential liability for punitive damages. Simply speaking, courts rule in the favor of employees and award large settlements to punish employers for wrong doings. When it can be shown an organization acted with "malice" or "reckless indifference" to the rights of employees, federal courts have and will continue to side for the employee.

On a positive note for organizations who have taken a proactive stance to recent changes in employment law legislation, the courts are ruling that employers could avoid costly settlements if the employer could show that it made "good faith efforts" to prevent harassment and discrimination. Courts, in defining "good faith efforts," stated the purposes underlying Title VII are advanced when employers adopt antidiscrimination policies and educate their personnel on Title VII's prohibitions. Federal court decisions all across the US have shown that to avoid liability and punitive damages in harassment and discrimination lawsuits, employers must educate their employees on how to avoid all forms of workplace harassment and discrimination.
