The Council on American-Islamic Relations (CAIR) today announced that a GL employee has filed a discrimination lawsuit against Intel over allegations of religion and national origin harassment, discrimination as well as retaliation.

The lawsuit, filed in U.S. District Court for the District of Arizona, claims the employee never received a verbal or written warning prior to September 11, 2001." On the contrary, he received merit increase, positive evaluations, and an accomplishment award.

According to papers filed with the court: "Since September 11, 2001, [the Group Leaders supervisor began making derogatory remarks... which included, but not limited to, 'Why [do your people want to kill Americans? and 'Why do the Islamic groups from the Middle East want to destroy the Western Civilization?... [The supervisor who is not a US citizen asked [him if 'he was religious and told [the Engineer if he 'wanted to go back to the Middle East[, to live and work there permanently"

On January 2, 2002, the plaintiff filed an internal complaint of discrimination. Within two and a half hours, the plaintiff was presented with a Corrective Action Plan and a continued harassment. Intel top management and Human Resources at Fab12, Chandler AZ refused to take the employee out of the hostile work environment and allow him to report to a different supervisor. Intel intensified its harassment and retaliation by changing the employees job title and description giving him tasks out of his area of expertise and a dead task, removed his supervisory responsibilities, and subjected him to hostile work environment. After one year of the systematic harassment, discrimination, and retaliation, the employee was constructively discharged on September 3, 2002.

According to the lawsuit: [Intel Corp intentionally, recklessly, and with malice, engaged in extreme and outrageous conduct, intended to cause, or in reckless disregard for causing, severe emotional distress to plaintiff..."

The lawsuit alleges that the plaintiff has been damaged in an amount to be proven at trial which includes lost wages, lost fringe benefits, future loss of wages, future loss of fringe benefits, prejudgment and post judgment interest, attorney fees and costs, pain and suffering, medical bills, loss of possessions, and monies for compensatory damages.

Employees at Intels Factory 12 should enjoy the same culturally diverse environment reputed at other Intel facilities," said CAIR-AZ Executive Director Deedra Abboud. said workplace discrimination is one of the largest categories of discrimination cases CAIR deals with nationally.

The plaintiff also has a whistle-blowers retaliation complaint pending against Intel alleging a scheme to defraud stock holders by illegally pushing out payments on invoices to meet Wall Streets expectations.
