Sam Liang v. D&D Gold et al

Golden Apex, Inc., and owner Sam Liang announced that, on February 5, 2009, the United States District Court for the Central District of California issued a preliminarily injunction against D&D Gold Product Corporation, Trong Van Nguyen, Que Lan Truong Nguyen, Hung Van Nguyen, and their affiliates that prevents them from manufacturing, distributing, shipping, advertising, marketing, promoting, selling, or offering to sell any product in packaging bearing the "D&D Gold" trademark or any trademark confusingly similar to "D&D Gold" such as "D&D Gold Product." The District Court also preliminarily enjoined D&D Gold Product Corp. and the Nguyens from manufacturing, distributing, shipping, advertising, marketing, promoting, selling, or offering to sell any product in packaging bearing the three bells trademark illustrated below:

Golden Apex, Inc., and owner Sam Liang announced that, on February 5, 2009, the United States District Court for the Central District of California issued a preliminarily injunction against D&D Gold Product Corporation, Trong Van Nguyen, Que Lan Truong Nguyen, Hung Van Nguyen, and their affiliates that prevents them from manufacturing, distributing, shipping, advertising, marketing, promoting, selling, or offering to sell any product in packaging bearing the "D&D Gold" trademark or any trademark confusingly similar to "D&D Gold" such as "D&D Gold Product." The District Court also preliminarily enjoined D&D Gold Product Corp. and the Nguyens from manufacturing, distributing, shipping, advertising, marketing, promoting, selling, or offering to sell any product in packaging bearing the three bells trademark illustrated below:

Sam Liang filed the lawsuit on December 12, 2008, to enforce an agreement between himself and the Nguyens/D&D Gold Product Corp. That agreement granted Mr. Liang ownership of all rights in the three bells trademark and prevented all parties from using the trademark "D&D Gold." Mr. Liang alleged in the lawsuit that the Nguyens/D&D Gold Product Corp. have breached that agreement and infringed Mr. Liang's trademark rights by continuing to sell products bearing the three bells trademark and the "D&D Gold" trademark. In issuing the preliminary injunction against the Nguyens/D&D Gold Product Corp., the District Court confirmed that Mr. Liang is the owner of the three bells trademark shown above. Mr. Liang is very pleased that the court order will help prevent any further confusion in the marketplace as to ownership of the three bells trademark.
