Optima Hires Attorney Bert C. Cozart for New Intellectual Property Licensing Program The recent public offering of amnesty with regard to Optimas licensing program as it concerns their patent 5,666,531 has been an overwhelming success and thus Optima has opened a new patent licensing program. In November 2004 Optima obtained a favorable ruling in their Markman hearing against Roxio/Napster. Roxio has since disregarded the courts ruling and Optima will now pursue the defendants to trial and request royalties and attorneys fees. Optima has also demanded that the Patent and Trademark Office invalidate the Roxio patents because the Roxio patent 6,226,241 specification, which is the same as the 6,091,686 specification, no longer supports the 6,226,241 claims to a system which forms the Directory Structure after each file is added to the disc, storing this Directory on the host system. It is not sufficient to invalidate 6,226,241 solely on using 5,666,531 as prior art. It must also be invalidated because the specifications no longer support the claims. Roxio changed them only in an outrageous attempt to take advantage of the early filing date."
