Grossman Law Offices settles Dram Shop Motor Vehicle Accident for $337,500, Cause No. 03-02540L, 193rd Judicial District Court

On or about April 15, 2001, Listen Literature Inc., d/b/a Hawley’s Billiards, served and sold alcoholic beverages to David Moore. After leaving Listen Literature Inc., d/b/a Hawley’s Billiards, Mr. Moore attempted to drive himself and James McElhenney home. Mr. Moore was traveling north bound on the Dallas North Tollway in Dallas, Texas. Mr. Moore caused an automobile accident resulting in serious and severe personal injuries and damages to James McElhenney. Mr. McElhenney was transported by care flight from the scene of the accident.

Based numerous Texas Alcohol and Beverage Commission violations, defendant Listen Literature Inc., d/b/a Hawley’s Billiards liquor license was revoked in November 2002.

Mr. McElhenney’s injuries included colon perforation, sprain strain of muscles, ligaments, and general jarring throughout the body. Mr. McElhenney endured two surgeries to repair his color perforation. Mr. McElhenney was forced to wear a colostomy bag for approximately 3 months. Mr. McElhenney medical expenses totaled $58,716.00. Mr. McElhenney’s lost wages was approximately $10,000.00.

The case ultimately settled for $337,500.00 pursuant to a mediation.
