Charges Reduced Against San Diego Man Charged with Rape of 14-year-old Girl Because of a poor investigation by police and the DA's office, the San Diego DA's office reduced the charges to simple battery. (PRWEB) January 25, 2006 -- Kent Hulsey of San Diego was charged on June 14, 2005 with sexually assaulting a 14-year-old girl at the Del Mar Fairgrounds in San Diego, where he was an employee of a vendor. San Diego Case No. SCN196135.
Rick Crouch, a private investigator was hired by the defense to investigate the case. Within a few weeks Rick Crouch had uncovered information that proved that the San Diego District Attorney's Office had "over charged" Mr. Hulsy, the incident did not happen as the victim and her mother had reported it to the police.
Rick Crouch said, "The evidence we uncovered included the background history of the victim and her family, as well as other compelling evidence that the police and DA's office had either ignored or not found."
Instead of conducting an investigation the San Diego County District Attorneys office was relying on the results from the DNA, which they were sure was going to come back positive to their suspect, Kent Hulsey. The DNA eventually came back and, there was none.
Because of the evidence gathered by Mr. Crouch during his investigation, the San Diego District Attorney's Office decided not to proceed with the case, but to offer Mr. Hulsey a plea bargain of simple battery with three years probation.
So, he went from a potential seven years in prison down to three years probation.
Mr. Rick Crouch said, "we come across so many of these criminal cases where our client, the defendant, is not guilty or at least not guilty of the charges charged, that is why it is so important that defendants in criminal cases and their attorneys hire competent criminal defense investigators."
