Houston Lawsuit Alleges Personal Training Sessions Left Woman With Serious Injuries

Case filed by Texas attorney Wyly Brad T. Wyly alleges negligence on the part of the Houston health club and its staff.

Nanette Plunkett hoped the Fitness Connection would help her lose weight through a personal training program.

Instead, the health club’s staff caused her to suffer serious injuries that have forced her to undergo major medical treatment and abandon some of life’s basic activities, according to a lawsuit filed this month by Houston lawyer Brad T. Wyly.

“Nanette spent months bedbound and homebound,” Wyly said. “She has only recently recovered to the point where she is able to walk with a cane.”

The Wyly Law Firm, P.C., filed the complaint on behalf of the 38-year-old Plunkett and her husband, Robert, on Jan. 13 in Harris County District Court, naming the Houston-based Fitness Connection as the defendant. The case is Plunkett v. New Fit, Ltd. (No. 2010-02123).

The couple claims they were forced to take action after the health club refused to acknowledge Ms. Plunkett’s claim or even refund her for eight training sessions she paid for in March 2009.

At the time she signed up for the sessions, Plunkett said she discussed her medical needs and concerns with a Fitness Connection personal trainer supervisor, and she was promised that a training regimen would be specialized to meet those needs and concerns.

But at her first session, a trainer worked Plunkett to the point of nausea and exhaustion, and at her second session, she suffered serious injuries to her lower back and spine — all of which the club’s staff initially attributed to her being overweight and out of shape, the lawsuit claims.

In the eight months since, Plunkett says she has required two surgeries, more than two weeks of hospitalization, numerous diagnostic tests, medication and physical therapy. She continues to treat for her injuries.

Putting on her shoes and socks are among the daily activities she can no longer do, Plunkett said.

According to the complaint, the Fitness Connection should be held liable based on its negligence, gross negligence and negligent hiring, supervision and management of its staff.

The lawsuit seeks exemplary damages.
