Planned Strike By Claims Adjustors Rattles Schwarzenegger As California Workers Compensation Meltdown Continues

Latest bad news about planned walk out doesn’t surprise work comp activists

Sacramento (PRWEB) May 11, 2006 -- News reports of a planned strike by claims’ adjustors employed by California’s State Compensation Insurance Fund (SCIF) appear to tarnish Governor Arnold Schwarzenegger’s boasts of reforming the workers’ compensation system according to state activists.

“This new threat of a planned strike underscores the recent lunch time pickets and mini-walkouts we have seen by SCIF employees over the past several months,” according to activist Larry Nign, who believes SCIF employs several thousand claims adjustors.

A recent lawsuit filed by an injured worker against a California claims adjustor under the anti-Ku Klux Klan act (42 U.S.C. 1985) that attempts to hold claims adjustors personally liable for unethical conduct may also be fueling concerns.

“Workers’ compensation is a constitutional public entitlement in California, the state has chosen to delegate that responsibility to claims adjustors, hence I allege certain claims adjustors are ‘state actors’ and can be sued in federal court under civil rights statues,” reports Barb Clark. Clark is a plaintiff in a federal lawsuit pending in Sacramento (see USDC for EDC 2:05-CV-02410, Clark vs. Rea).

A rally of support is scheduled for Barb Clark on Wednesday, May 17th on the steps of the Sacramento federal courthouse, 501 I Street, between 11:30 am and 1:30 pm.
