This particular case (case# ISCR 06-13808) involved an applicant who is a 60 year old engineer that held a Security Clearance for many years. He worked for several defense contractors and was terminated from his employment for misuse of a company credit card. At the hearing Attorney Edmunds, upon direct examination, showed that the Applicant's explanations and rationale for his actions were sufficient to explain and provide a correct analysis of the concerns raised in the Statement of Reasons.

Throughout the hearing numerous witnesses were introduced on behalf of the Applicant and taken under direct examination by Attorney Edmunds. Volumes of exhibits were admitted into evidence by Attorney Edmunds in favor of the Applicant.

The allegations in the Statement of Reasons centered around the Applicant's misuse of a credit card, his discharge from employment and his statements to the investigator for the proceeding at hand from the Office of Personnel Management.

Although the Government vehemently argued that it was not in the best interest of the United States to grant a clearance, and further argued that "no one has a right to a Security Clearance," Attorney Edmunds argued that the allegations contained in the Statement of Reasons under Guideline E and the allegations under Guideline J should not be sustained and that the inference is strongly overcome by the presentation of evidence, the testimony of the Applicant and suggestion by Applicant's attorney to consider the "whole person" concept in viewing the totality of facts and omissions. Upon considering the evidence and the statements of counsel, the Administrative Law Judge found in favor of the Applicant for each and every allegation raised in the Statement of Reasons.
