The lawsuit from which the settlement arose was filed in the Riverside County Superior Court, case # RIC 1105609. According to the suit, on June 10, 2010, an 81-year-old Carlsbad, CA, woman driving a Hyundai exited the off-ramp of northbound Interstate 215 at an estimated speed of 50 mph. The vehicle made an unsafe turn, colliding with the center median and then into a Mazda in the westbound lane of Newport Road. The impact caused the Mazda to overturn, and the man driving the vehicle, the plaintiff’s husband, was killed. The front-seat passenger in the Mazda, the plaintiff, suffered injuries including multiple broken bones. Three children in the vehicle, the couple’s grandchildren, witnessed the incident.

The lawsuit alleged that the driver of the Hyundai bore responsibility in this case due to negligent operation of her vehicle, primarily failing to drive at a reasonable speed when she attempted a right turn while driving too fast for the posted speed limit and prevailing conditions.

While we are pleased with the result, this is a tragedy that easily could have been avoided, and nothing will ever replace our client’s devastating loss.”
