Has the NFL Paraded into the Wrong Endzone?

HAS THE NFL PARADED INTO THE WRONG END ZONE?

MISSION VIEJO, CA (PRWEB) January 14, 2004 -- Blowing the whistle on the National Football League, a nutritional supplement company has sued the NFL for boycotting and disparaging the companys products.

Formulated Sciences, Inc. (FS) claims in its lawsuit that the NFL wrongfully banned its products, DemocaineTM and DuzoxinTM.

The NFL dropped the ball big time," he said. The NFL has banned a host of substances, but our products do not contain any of those substances."

The NFL and the National Football Players Association (NFLPA) agreed upon the list of banned substances two years ago with stiff penalties for players who violate the agreement. Banned substances include derivatives of natural products such as Ma Huang, which is also known as Ephedrine. The policy has stirred controversy around the country because penalties for illegal drug use, like heroin, cocaine, and marijuana are much lighter than the punishment for use of nutritional supplements.

Not only does the policy penalize football players for using the banned substances, it forbids them endorsing the companies that promote the substances. The banned list includes about four dozen companies, including industry leaders FS, GNC, MetRX and TwinLabs.

In the FS v. NFL case, the complaint says that the NFL has violated state and federal laws against anti-competitive and unfair business practices. It also claims that the NFL libeled DuzoxinTM and DemocaineTM.

The lawsuit seeks damages of at least $13.5 million, based on a contract agreement with all-star wide-receiver Terrell Owens of the San Francisco 49ers. Owens Signature Line of products that included Democaine and Duzoxin was to be available to the nutritional supplement market in early 2001. But when the NFL issued its banned substances list, Owens withdrew his partnership due to the stiff penalties for non-compliance.

FS learned it was on the banned list earlier this year when the list appeared on the NFLPAs website. FS informed the players association that the list was wrong. The association currently continues to publish the banned list with FS still on it. Unfortunately the list is not exclusively on the NFLPAs site, it has been copied and published on numerous other web sites wrongfully exposing FS and their products.

William K. Vogeler, attorney for the plaintiffs, said the case will be difficult because the NFL has far more resources to fight than FS. But, he said, his client has an advantage. The truth is our advantage," he said. The truth is that FS does not have any of the banned substances in its products. As well, the NFL should stop boycotting and disparaging them."
