Southern Judge Sides With Accused Child Molester To Put Mother Of Eight In Jail

SALT LAKE CITY -- In rural northern Florida, Nancy Caudle, mother of eight, stands trial for protecting her children. Her ex-husband of 29 years, Bill Caudle, has driven from Utah to, in his words, put her in jail and take back his children." This is in spite of the fact that the youngest children, ages 13 and 15, do not want to visit their father.

For over 15 years, Nancy and her children suffered physical attacks and verbal abuse from her husband, including her daughters claims of being sexually molested by their father. It was not until after he beat her and broke her ribs that she got a restraining order and filed for divorce.

Bill, a practicing attorney in the county, teamed with his longtime acquaintance, Judge Paul A. Rasmussen of Santa Rosa County, Florida. They filed a series of orders that continue to harass Nancy and the children.

In spite of the history of abuse and medical records to support it, Judge Rasmussen ordered Nancy to allow her abusive ex-husband to live in the rear of the house, separated by only a door. Bill continued to insist the children visit him in his part of the house, making them sleep on the floor, rather than allowing them to return to their beds only a few feet away. He left Florida, possibly because he was disbarred in that state from legal practice, 12 months in 1998. While disbarred for dishonesty and deceit, he continued to pursue legal action against Nancy.

Because he is a lawyer and can do his own filing of charges, without legal fees, he has no motivation to stop repeated court actions against his ex-wife, who cannot afford to keep defending herself against his barrage of nuisance suits.

In December 1999, he arranged flights from Mobile, Alabama, to his home in Salt Lake City, Utah, where he has remarried and now lives. The flights were scheduled for December 24th with a return flight on New Years Eve.

As did a large part of the world, Nancy had fears about the safety of her children on New Years Eve, so she kept her children at home.

As a result, Bill filed a contempt of court charge last month and it is was approved by Judge Rassmussen. Nancy, a special education aide at the local high school, had a public defender appointed to defend her in her upcoming arraignment date.

Because of repeated efforts by Bill to have Nancy fined for various court costs, Judge Rasmussen stated last year that he could no longer fine her, as it was only taking needed support from the children. However, last week in Santa Rosa County, Judge Rasmussen assisted Bill in the first steps towards punishing Nancy for trying to live in safety with her children.
