YANK MAGAZINE FILES SUIT AGAINST SAN FRANCISCO
FOR VIOLATIONS OF FREEDOM OF THE PRESS & FREE SPEECH
Yank Magazine's publisher, David Moreno, has filed suit against the City and County
of San Francisco for violations of his publications right to Freedom of the Press, Free
Speech and Due Process. Daniel Brugmann, S.F. Counties Newsrack Program Manager
and who is also the son of Bay Guardian publisher Bruce Brugmann, was listed as an
additional defendant.
San Francisco, CA -- April 3, 2002 -- Yank Magazine's publisher, David Moreno of San Mateo County, has filed suit against the City and County of San Francisco for violations of his publications right to Freedom of the Press, Free Speech and Due Process, along with other violations of Mr. Moreno's constitutional rights. Daniel Brugmann, S.F. Counties Newsrack Program Manager and who is also the son of Bay Guardian publisher Bruce Brugmann, was listed as an additional defendant in the case.
Yank Magazine initially filed a claim against the CCSF in January 2002, after the illegal seizures of 22 of Yanks newsracks by the SF Department of Public Works between the dates of June 26, 2001 through December 19, 2001. The claim was promptly rejected. The suit was filed in California Superior Court on Wednesday, February 27, 2002, Case No. 404969.
Mr. Brugmann has been listed individually in this suit, as he is responsible for the citing and seizure process of newsracks within the County of San Francisco. The suit also claims that the CCSF and Mr. Brugmann have used selective enforcement to harass Yank and seize the companies newsracks, and that intentional and negligent infliction of emotional distress upon Yank's publisher has taken place.
Prior to his filing the lawsuit, Mr. Moreno had filed three separate police reports with the S.F. Police Department in which he claimed the S.F. D.P.W. had been taking his companies newsracks. Mr. Moreno also states he has written to City Attorney David A. Greenburg and others within the San Francisco City Attorneys office to complain about the DPW's harassment of his company. He has kept records of letters to the City Attorney's office dating back to August 19, 1998. To his knowledge, no action has ever been taken on his behalf.
