IS AT-WILL EMPLOYMENT AND WRONGFUL TERMINATION ON THE WAY OUT IN SOUTH CAROLINA?
MYRTLE BEACH- At-will employment and wrongful termination will be a part of the past if Richard T. "Doc" Quillian has his way. Quillian who has run for office in this state since 1988, for Solicitor, State Senate, and twice for US Senate (against Strom and Fritz) is now fighting big business and the States practice of at-will employment. Most South Carolinians work "at will"--their own and the employer's. That means there is no fixed term for the employment relationship, and while employees can quit without reason, they can also be fired without cause: for a good reason, a bad reason, or no reason at all. Quillian says they promise you everything in their handbooks then they let you find out the hard way that you have no rights or expectations by being a good employee...".
On July 11th of this year Quillian representing himself and the other Plaintiff in his suit against E-Z Serve Convenience Stores, d/b/a Swifty Serve, et al, appeared before the Hon. Steven H. John, Resident Judge for the 15th Judicial Circuit Court of common Pleas in Conway, the hearing was for Summary Judgment (a summary judgment has the most rigorous evidentiary standard and that any evidence will allow the case to go to trial) Judge John ruled in favor of Quillians side and the Case No. 01-CP-26-3636 is expected to go to trial soon with Quillian representing the Plaintiffs. Quillian is suing for $50,000.00 for slander and wrongful termination this with the back pay and possible punitive damages could be as high as $100,000.00. Quillian has tried to settle out of court for $6,000.00, a written apology and changes to be made to the employee handbook, Swifty has refused. Quillian has relayed thru the Defendants Attorney that if he wins this case it will become case law and would have an effect on at-will employment in this State and perhaps give all employees rights they would not normally have. Over many years the SC State Legislation has tried to come to grips over at-will employment but to no avail. Quillian says, the State cares more about the employer than it does for the employee, its time for a bill of rights for our states workers".
Quillian also said, in case you havent noticed there have been a lot of Swifty Serves closing here in the Myrtle Beach area perhaps because Ive been asking people I know not to do business with them".
