"ON JAN 04, 2002, I, Dave Kaback of Calimesa, Ca, had all the symptoms of a major heart attack, already surviving a heart attack in 1995 and a triple BI-pass operation I was aware of the symptoms of a heart attack. Since I am unable to pay 3 past ambulance bills, which all went to collection agencies I decided to drive himself to the nearest hospital or fire station, which is only 3/4 of a mile from my home.

Upon entering my regular auto, it would not start due to a dead battery, my only other choice was to get into my 1979 Chevrolet Station Wagon, which was unregistered and uninsured, but in perfect working order,

I knew that time was critical in a heart attack situation, I had read that constant coughing is just like shocking the heart back into normal rhythm, so I coughed and coughed as I drove!

I got less that 6 blocks when an office gave me a ticked for not having proof of insurance and driving an unregistered vehicle.

I told the office that I was not feeling well, but the office took an additional 30 minutes just to write out the citation, due to the fact that he did not know the vehicle code number of the violation, this was later correct by mail from his superior at the Riverside County Sherifs office, putting down the correct Vehicle Code violation numbers.

It turned out that I was not having a heart attack, but a panic anxiety attack! The office gave me the citation and I returned home, and took my anti-anxiety medication.

Sending medical records regarding my heart condition as well as panic attacks records from the VA hospital in LOMA Linda, I was able to show via mail TO:

BANNING, CA 92220

That the only reason for driving the unregistered and uninsured Chevrolet Station wagon, was to save my life, I have ask the commissioner to please dismiss the charges many times. Commissioner Moyer refuses to dismiss the charges! In a letter dated May 20, 2002, demanding that full payment be made on the citation or:

"THE COURT WILL INITIATE A CIVIL ACTION AGAINST ME, INCLUDING AN ADDITIONAL $152.00 CHARGE, AND POSSIBLE SUSPENSION OF DRIVING PRIVILEGES [Vehicle Code 40509.5]
Wage garnishment and/or a lien on my property."

A second letter explaining my medical condition, allowed me to be able to come to court and plead "NOT GUILTY" but Commissioner Moyer still would not dismiss the charges!

Suffering from Agoraphobia and Panic Disorder, will not allow me to travel to Banning California, without experiencing massive panic attacks, which I would avoid at all cost.

I feel that commissioner Moyer is acting unreasonable, not to drop these charges on citation 904139, with all the evidence of my medical condition, which was sent to her via regular mail.

Perhaps with the media's help, we can inform Commissioner Moyer what Agoraphobia and panic disorder are, I am willing to have a trial in my home, but am unable to travel to Banning Ca. Due to my agoraphobiac condition.

I feel that Commissioner Moyer is exploiting and dominated me due to her power as a Commissioner, and not accepting the facts in this situation, I am a law abiding citizen of the United States of America, and served in our armed forces during Viet Nam. (Drafted)

In closing what was my crime? Trying to save my own life ? Which I guess is not worth much these days.
