If you receive Medical Assistance, plan on making more than one trip to the pharmacist and/or your doctors office.

People are forced to go through a process of drug elimination in order to find out that the most effective drug was the potent brand name. Allergies, side affect, poor record keeping, etc. When will the class action law suits against the State of Minnesota begin?

Attention: POOR PEOPLE

If you receive Medical Assistance, plan on making more than one trip to the pharmacist and/or your doctors office. Don't plan on getting the same medication as your doctor intended/prescribed. Due to the Minnesota policy changes regarding the COSTS of prescribing brand name drugs the state are now in the prescribing business. This means that if the drug your doctor prescribed is not on the Preferred drug list"(formulary committee) the pharmacist cannot dispense without prior authorization from the State. This process has taken anywhere from 1 to 7 business days. One way around this hassle is if your doctor writes "DAW medically necessary" on your prescription (DAW stands for "Dispense as Written").

See http://www.dhs.state.mn.us/provider/pharm/DFCguidelines.doc
For complete details.

Issues:

Can the poor person get access to the preferred drug list"?
Keep trying!
1.   Is the Doctor aware of the drug change? If yes, how can we be assured that this report back to the doctor" is happening and effectively/timely!

2.   How is it reflective in my medical record that my medication was switched?
This is a major liability the state is assuming. Allergies, side affects, etc.
When will the lawyers catch wind of this and start the law suits?

3.   Perhaps, you have already tried this alternative drug listed on the preferred drug list from a different doctor or from a separate health plan? Before you were cancelled due to job loss/transfer, income increase/decrease, your company switched plans. Without yet ANOTHER database (tracking a poor persons medication history from all pharmacies) it would be impossible to know whether or not this medication was already tried.

4.   Does this poor person keep track of all their medications? Not likely if they
are homeless, in crisis, mentally challenged, or not capable for other reasons. Particularly since they lost there support services due to the recent CUTS.

  • Has this poor person had more than one Doctor in the last ten years?

6.   Has this poor person used the same pharmacist in the last ten years?

People are forced to go through a process of drug elimination in order to find out that the most effective drug was the potent brand name. Lets stop wasting time and especially money! This means a longer time suffering with symptoms, more doctors visits, and pay losses. This costs" more money to the counties and state of Minnesota.
