(PRWEB) October 31, 2003 --BillingNetwork, a provider of medical billing solutions and services for the healthcare industry, today announced that it obtained a federal court order in Chicago, Illinois on August 26, 2003 against Infosys, Inc. which had attempted to prevent BillingNetwork from offering to license its U.S. Patent No. 6,374,229 directed to a web based medical billing system.
The court dismissed the suit filed by Infosys, Inc. to contest validity of BillingNetwork's patent. BillingNetwork had offered Infosys a license under the patent. In response Infosys filed suit seeking a declaration of invalidity and noninfringement of the patent. The court found Infosys did not have grounds to file the suit against BillingNetwork. There was no basis for Infosys to bring suit because BillingNetwork had not accused Infosys of patent infringement. The court held that Infosys could not prevent BillingNetwork from offering a license by filing a suit for noninfringement. BillingNetwork is free to continue its license negotiations.
