DIVORCED VETERANS CHALLENGE LAW PERMITTING THEIR EX-SPOUSES TO SHARE THEIR RETIREMENT PAY
After twenty years of legislative efforts, divorced veterans have banded together to bring a court challenge against a law that permits divorce courts to treat veterans' retirement pay as marital property that is subject to division among divorced couples.
Tampa, FL (PRWEB) November 8, 2003 -- After twenty years of legislative efforts, divorced veterans have banded together to bring a court challenge against a law that permits divorce courts to treat veterans' retirement pay as marital property that is subject to division among divorced couples.
Veterans adversely affected by the law have united in support of the USFSPA Litigation Support Group (ULSG, LLC), an organization of commissioned and non-commissioned military officers dedicated to the repeal of the Uniformed Services Former Spouse Protection Act (USFSPA). The ULSG contends that the USFSPA allows individual state divorce courts to arbitrarily and inconsistently decide the division of military retirement and retainer pay. The veterans group contends that such pay should not be subject to divorce court division.
For its court challenge, the ULSG has retained a team of Constitutional attorneys comprised of Jonathan Katz of Silver Spring, Maryland, and David Bederman of Atlanta Georgia.
The USFSPA affects more than 100,000 veterans. The ULSG contends that the law has been inconsistently and unfairly applied, and has become a means of exploiting military veterans entitlements. The USFSPA does not allow the monthly retirement/retainer pay to an ex-spouse to be terminated when the ex-spouse re-marries. Payments cease only upon the death of the servicemember or the ex-spouse. These rules of payment for ex-spouses apply only to military veterans, with no comparable legislation for any other governmental agency, department, or bureau.
The ULSG expects that its court challenge to the USFSPA will need to be hard fought as part of an ongoing struggle for US military veterans to receive fair divorce court treatment of their retirement pay.
