Future-Link Forges ahead with WebTV Litigation: Los Angeles Court Approves Date for Jury Trial
WebTV, a wholly-owned subsidiary of Microsoft Corporation, is charged with interfering with the contract of Future-Link, a New Jersey-based internet service provider.
Nutley, New Jersey, November 2, 2003. WebTV, a wholly-owned subsidiary of Microsoft Corporation, is charged with interfering with the contract of Future-Link, a New Jersey-based internet service provider. Future-Link claims that given the nature of the Internet business in 1997 they were on target to become one of the largest Internet providers in terms of number of dial-up subscribers. According to David P. Durko, the CEO of Future-Link: We were emerging in what was then a fledgling industry until WebTV crushed us without a thought or regard for the law." Future-Link was forced to close its doors in mid-1997, allegedly, as a consequence of WebTVs interference with their contract.
Obviously WebTV thought enough of our clients to want them; now its time they pay us for each one of them," declares Mr. Durko, we only want what is due us and not a penny more." Future-Link claims that based on industry numbers and best estimates, Future-Link was valued at more than $20 million dollars at the time WebTV interfered with its contract and, effectively, shut it down.
The four original founders of Future-Link have vowed to see their case to the end. Earlier this year, in a striking victory, the California Court of Appeal reversed a summary judgment for WebTV and opened the way for Future-Link to pursue its lawsuit against WebTV. The Los Angeles Superior Court has now confirmed a January 26, 2004 date for a jury trial.
