WHAT: President Bush indicated he will sign the CAN-SPAM Act of 2003 (Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003), which was approved by Congress on Monday. While few can disagree with the ActÂs intentions, it is anticipated it will fall significantly short of consumer expectations.

ÂDonÂt throw away your anti-spam filter. Since 83.5% of spam comes from disreputable sources that may skirt or ignore CAN-SPAM, you can expect to keep seeing most of the spam you see today.Â
(An FTC study reported that only 16.5% of spam comes from sources that are legitimate advertisers offering legal products.)
ÂÂCAN-SPAM will help because it tells legitimate e-mail marketers what they can and cannot do. It also gives tools to the government to fight those who flaunt the rules. But, it is clearly pro-business legislation that could increase the amount of mail you receive. If they abide by the rules, email marketers can send whatever they want. It wipes out many tougher state laws and protects mailers from law suits by individual email users.Â
ÂThe newly authorized Do-Not-Spam registry is dangerous for consumers. For it to work, the FTC would assemble the worldÂs largest list of valid e-mail addresses from trusting Americans. Then, it must make it available at no charge to anyone who asks or the list wonÂt work. Unfortunately, that means that overseas spammers also could get the worldÂs most complete list of valid American email addresses directly from the U.S. Government for free. The result will be less legitimate emails and more of the worst kind of spam.Â
