Judge Orders Aztectalk.com Dismissed from Hotly Contested Internet Defamation Lawsuit

San Diego County Superior Court Judge sustains challenge by Defendant Aztectalk.com to Plaintiff's Amended Complaint, and orders Aztectalk.com and its Owner/Operator dismissed from the Bartel v. Ohton lawsuit.

Internet website Aztectalk.com, and its owner/operator Mr. Edward Morris, welcome the ruling of May 28, 2004 by the Hon. S. Charles Wickersham, Judge of the Superior Court. In a concise, well-reasoned opinion, Judge Wickersham sustained Aztectalk.com's challenge to the Plaintiff's Amended Complaint, and also dismissed defendants Aztectalk.com and Mr. Morris from the lawsuit. The Plaintiff's lawsuit will apparently continue unabated as against the remaining defendants.

The ruling occurs nine (9) months after a lawsuit was filed against several persons and organizations, including Aztectalk.com and Mr. Morris, in the case of Bartel v. Ohton, San Diego Superior Court, case GIC-816742 (filed August 26, 2003). Among other contentions, the lawsuit accused Aztectalk.com of defamation and related claims on the basis that it allowed various persons to post messages on the Aztectalk.com website, which such messages allegedly defamed and injured the plaintiff Mr. Stephen G. Bartel, an employee of San Diego State University’s Athletics Department. Allegations pertaining to Mr. Bartel and other current and former employees of San Diego State University were part of an eleven (11) month long official inquiry by the California State University into the operations of the Athletics Department at San Diego State University, and those allegations were and still are the subject of substantial reports and articles in the local and national press. The claims against Aztectalk.com were hotly contested and vehemently disputed.

Aztectalk.com closed and permanently ceased operation during the first quarter of 2004. Aztectalk.com was a not-for-profit association, operated for the benefit of the San Diego sports community and fans of the San Diego State University athletic teams, and its owner/operator was unable to maintain the website while subject to the duress of expensive civil litigation.
