Lee Rosen Urges Legislature to Abolish Alienation of Affection

North Carolina is still one of a few states where alienation-of-affection and criminal conversation lawsuits are allowed. In 2003, the bill to abolish the alienation-of-affection and criminal conversation torts in North Carolina passed the House, but failed in the Senate.
These torts are archaic methods for eliminating infidelity and do not protect marital relationships," said Rosen. In North Carolina, under the alienation-of-affection law, a spouse can sue for money damages based on allegations of emotional harm caused by a third party to the marital relationship. These laws rest on the belief that wives are property of their husband," Rosen said, and that if someone steals a wife from her husband it would deny the husband benefits of his property."
Different states vary widely in the way they deal with this issue: in some states, only one of the two causes of action continues to exist, and thus proof of the claim and/or damages has been significantly curtailed in recent years. None of these reforms has altered the position favoring such claims in North Carolina.
Rosen said, The alienation-of-affection and criminal conversation laws not only make divorce messy, it is punitive in nature, and extremely painful to the parties involved. The world has changed so much since this law was created-women are no longer viewed as property."
