Whether you are heavily involved in real property matters on a daily basis or occasionally advise clients on rights-of-way or split estate issues, you need to be aware of the essential legal and practical issues associated with easements. The materials and presentations offered at this seminar will allow participants to gain a better understanding of the definition and characteristics of an easement, how easements are created, including a review of condemnation law, the correlative rights between fee and easement owners, as well as competing easement owners, and a discussion of Wyoming's new split estate legislation.

David G. Ditto, a lawyer with Associated Legal Group, LLC, focuses his practice on eminent domain, rights-of-way, license issues, real estate, tort and insurance litigation, employment litigation and commercial litigation. He has represented a number of oil and gas companies, and telecommunications companies and other utilities in matters relating to easement disputes, construction of fiber optic cables and pipelines, and land priority issues. Mr. Ditto has substantial experience enforcing easement agreements and licenses by use of temporary restraining orders and injunctions. He routinely handles litigation relating to insurance and employment issues, and has lectured and written articles for various special interest groups including the Wyoming State Bar Association, Wyoming Lodging and Restaurant Association, Wyoming Claims Association, Council on Education in Management and the Wyoming Hospital Association. Mr. Ditto received his B.S. degree from Brigham Young University and his J.D. degree from the University of Wyoming. He is admitted in both Wyoming and Colorado, and is licensed to practice in all state and federal courts in both states, as well as the United States 10th Circuit Court of Appeals. Mr. Ditto is also a member of the International Right of Way Association.

Peter C. Nicolaysen is a member of Peter C. Nicolaysen & Associates, P.C. in Casper. His practice is centered around real estate and contract litigation. Mr. Nicolaysens other areas of practice include business and agricultural transactional and litigation matters. He received his B.A. degree from Saint Olaf College in Minnesota and his J.D. degree from the University of Wyoming. He is admitted to practice in Wyoming and Colorado.
