Knockout Punch for Fashion Web Site, "FIRSTVIEW"
Well known Internet fashion publication wins big, while New York court says no way to a decision made by the French courts.
New York, NY (PRWEB) October 7, 2005 -- A United States District Judge dismissed the claims of several French fashion houses to shutdown FIRSTVIEW, a fashion Web site specializing in publishing photographs of men's and women's designer fashion collections from runways around the word (United States District Court, Southern District of New York - 976104A). A French court's award of damages to fashion designers who claimed that a U.S. Web site operator posted their designs on the Internet without authorization is not enforceable in American courts.
According to Judge Lynch, "Fashion shows are a matter of great public interest, for artistic as well as commercial purposes, he said. "These shows are open to the public, including the press—indeed, defendant's employees and agents were able to take photographs at issue because they were given access by invitation…and the extensive coverage given to such events in various mass media makes clear that there is widespread public interest in these matters."
Attorneys for FIRSTVIEW, Steven Hyman and Paul Levinson of McLaughlin & Stern, LLP, were extremely pleased with this decision. Their client, FIRSTVIEW, persisted and today their site has a digital archive of over 2 million images, used by over 400 publications in the United States alone for photo features. The Web site receives over 1 million page views per day from editors, designers and shoppers.
