Events over the last year have highlighted the importance of having a policy with the retention and destruction of documents generated or collected during an engagement. The destruction of client documents on a random, case-by-case basis is asking for trouble if problems arise in the future. You do not want to face the anger of a client, or worse, the defense of a lawsuit, if a document destined for the shredder instead finds its way into unfriendly hands. This seminar will not only provide you with guidelines for retaining and destroying documents, but it will also clarify what your rights are.
Thomas E. Graham is a partner in the intellectual property practice at Moore & Van Allen, and is one of the leaders of the Information Technology and E-Commerce Group of the firms Charlotte office. His practice focuses on advising and counseling clients regarding the creation, protection and transfer of intellectual property, including patents, copyrights, trademarks and other proprietary information. Mr. Graham represents businesses that market products and services via print, television and e-commerce media, and distribute them throughout the United States and worldwide. His clients include software developers, Web-based direct response marketers, manufacturing companies, and wholesale and retail distributors. Mr. Graham has substantial experience in outsourcing, conducting intellectual property due diligence reviews, negotiating distribution and marketing agreements, Web site design, domain name protection and software distribution, and intellectual property licensing. He is also an experienced litigator in the areas of false advertising, trademark and trade dress infringement, and commercial disputes, as well as creditors rights and bankruptcy. Mr. Graham is admitted to practice in North Carolina, and he is a member of the North Carolina Bar Association. He is also a member of the American Intellectual Property Law Association and the Copyright Society of the U.S.A. Mr. Graham earned his B.S.B.A degree, summa cum laude, from Ohio State University and his J.D. degree, with honors, from The George Washington University.
Wood W. Lay is a partner at Hunton & Williams, where he practices in the Litigation, Intellectual Property, Antitrust And Labor Group. He received his J.D. degree, cum laude, from Washington and Lee University, where he was awarded Order of the Coif and was editor-in-chief of the Law Review, and he received his B.A. degree from the University of Virginia. Mr. Lay has significant experience litigating matters in both federal and state court. He was part of a team that defended a Fortune 500 company against class action ADEA, ADA, ERISA and state law claims. Mr. Lay has represented a Fortune 500 retail company in noncompete and trade secret litigation involving senior executives. He has significant experience in ERISA breach of fiduciary duty and denial of benefits litigation, and has defended clients in North Carolina, Pennsylvania, South Carolina and Virginia against significant OSHA fines, including the largest proposed fine in North Carolina history. Mr. Lay is a member of the North Carolina State Bar; the Virginia State Bar; and the North Carolina and American Bar Associations. He regularly speaks at continuing education seminars.
Daniel Peck is the founding principal of FileVault, LLC, a full-service records management firm in Charlotte, North Carolina, whose team executes programs of hard copy records management, secure destruction, imaging, data entry, and backup media vaulting and rotation for its clients. Mr. Peck serves as a director of PRISM International, the trade association for professional records and information management firms. He received his undergraduate degree from Princeton University and his masters degree from Columbia University.
Steward W. Scher has been providing document management and archiving consulting services since 1998 with Sovidian, LLC. His expertise is in designing document imaging and retrieval systems. From the scanners used to capture the images to the retrieval software at the end-user workstations, Mr. Scher tailors his solutions to meet the needs of his clients. He assists them with addressing security requirements; productivity issues; tracking issues such as providing regulatory-compliant audit trails; data sharing across networks, intranets and the Internet; and disaster recovery processes. His design work with the American Red Cross, Coca-Cola, Honeywell and other clients has saved hundreds of thousands of dollars in storage and document management processing costs alone. During his three-year tenure as president of the Piedmont Chapter of The Association of Information Management Professionals (ARMA), Mr. Scher became nationally recognized as a speaker and leader in the records management arena. As president, he was invited to address many groups and associations regarding records management, and today he continues to be asked to share his knowledge and recommendations. Mr. Scher has an M.B.A. degree from Devonshire.
