The session entitled “Will your electronic transactions and records stand up in court?” is scheduled for Thursday, January 26, 2006 at 2:00 pm EST. This presentation will provide an overview of the types of documents and activities that are affected by compliance requirements when substituting paper-based document signing processes with an electronic equivalent.

Electronic signatures are an essential part of any eBusiness or eGovernment initiative. Without this capability, processes can only be partially automated and will still be burdened by the inconvenience and cost of printing to paper whenever a signature is required.

Despite significant benefits, concern that electronic signatures could increase exposure to risk has prevented some organizations from moving forward. A ruling in December, 2005 by a New York court recommended the State Police improve their existing signature system to reduce future legal uncertainty. This illustrates the need for proper knowledge of the related laws, regulations and business policies, prior to implementing eSignatures.

The web seminar will provide a framework for understanding the legal issues surrounding electronic signatures and documents with focus on: US eSignature legislation; industry-specific compliance concerns; requirements for creating enforceable eSignatures and records; implementation examples; and an overview of existing jurisprudence.
