New Jersey Senate Enacts New Medical Law

The New Jersey Senate decides that the Respiratory Therapy "Scope of Practice" wording is keeping patients from proper treatment. A New Bill to license Registered Sleep Technologists is enacted.

In the last decade patients have been denied the professional medical treatment needed to cure life threatening obstructive sleep apnea (OSA) and the over 80 AMA listed sleep disorders. In recent years sleep disorders have been receiving more attention. The National and State Respiratory Care Associations realized this. They used a sentence in the Respiratory Therapist “Scope of Practice” guidelines to effectively disenfranchise Sleep Professionals from practicing the profession Sleep Professionals created.

The professionals in sleep disorders have spent their working lives in this pursuit. Tireless efforts to educate physicians and alert government to the staggering numbers of Americans with this deadly disease (OSA).

This tireless work is paying off. Sleep Disorders are mentioned in all media. People want and need sleep testing.

What is the current overview? Patients are waiting absurd lengths of time to be tested. The Sleep Professionals that remain in Sleep are training Respiratory Therapists to perform sleep studies.

So many Sleep Technologists had no choice. They turned to other professions to make ends meet. The average Respiratory Therapist is not greatly interested in sleep. They are eminently qualified and trained in their profession. The Respiratory Care Association’s Attorneys have done well. Too well.

The answer is other States follow suit. Hopefully, New York Legislatures will join New Jersey. I would like to see my mentors in sleep medicine return and get this problem resolved. Over 75,000 Americans will die this year from untreated OSA. It has taken the life of the great Reggie White- a proud, respected, Hall of Fame Football star in his prime.
