Steamscenes Legal Defense Fund Established

(PRWEB) February 15, 2006 -- www.HelpSteamScenes.com has been established to create awareness of the lawsuit of Union Pacific Railroad vs. Nils Huxtable, and to support the Steamscenes Legal Defense Fund.

Since the 19th Century, both amateur and professional photographers have recorded the dramatic progress of America's railroads. These images not only provide a historical record of our rail transportation network, but have advanced the art of photography itself. Their works have been published for many years in books, magazines, calendars and other photographic collections.

Unfortunately, the artistic rights of railroad photographers are under attack. In 2005, the Union Pacific Railroad filed a trademark infringement lawsuit against noted railroad photographer, Nils Huxtable over publication of Steamscenes' "Union Pacific Calendar", a title he first published in 1994. The name "Union Pacific" is used only to describe the content of the calendar in the same way that a photographic album, book or other historical work does.

Ron Paludan, working on behalf of the Steamscenes Legal Defense Fund, stated recently, "Union Pacific Railroad Company's use of its vast legal resources is harming Steamscenes, a small company that produces publications that ironically enhance U.P.'s public image. In no way could Union Pacific Railroad Company's calendar and the Steamscenes' calendar be confused, as "A Steamscenes Publication" is printed right on the cover of every calendar. In our opinion, the Union Pacific Railroad's case lacks merit and its interference with Steamscenes' business is unwarranted. We seek to ensure that this suit is settled by revelation of facts and fair application of law, rather than won by the company who has the most financial resources."
