Unemployment Rates are Down but California Employment Law Violations are on the Rise

A California State law firm, through LawyersandSettlements.com, provides free legal case evaluations for unpaid overtime and other employment law cases.

Los Angeles, CA (PRWEB) April 20, 2006 -- California State has aggressive labor laws to protect employees from intentional or unintentional law violations. Due to the nature of these law violations, employment law specialists are advising employees, regardless of career level or industry, to learn more about California’s labor codes.

A fast-growing violation of California labor law involves denying overtime pay or misclassifying employees as exempt from overtime pay. Unexempt employees may be paid hourly, salary or by commission. Employees who work over 8 hours per day may qualify for overtime pay of one and half times the regular hourly wage and working over 12 hours per day qualifies for two times the regular wage.

California also has separate overtime pay laws for certain industries. Computer programmers must earn more than $47.81 per hour in order to be exempt from overtime pay. Commissioned employees and salaried employees may also qualify for overtime pay if they meet certain conditions.

Another major law violation is harassment and discrimination in the workplace. Harassment and discrimination come in many forms and according to Federal laws, it is unlawful to discriminate based on race, national origin, religion, age, gender, sexual orientation, disability, or pregnancy. California has a high rate of immigrant employees, many have Lawful Permanent Resident (LPR) or green cards or are working with H1, H1B or H2 Visas. These employees are protected under California labor laws and anti-discrimination laws.
