All Bets Are Off – US Online Gaming Legislation Takes Away People’s Right to Choose

The day we have all dreaded has finally arrived. On July 11, 2006, the US government passed legislation prohibiting US-based financial institutions from accepting payments for online gambling. This essentially disallows US citizens and people from around the world who transfer funds through a US financial institution from using their money for the purpose of online gambling. The bill, H.R. 4411, “prohibits the use of certain payment instruments, credit cards, and fund transfers for the purpose of unlawful Internet gambling, and for other purposes.”

Not only does this recent legislation affect how US citizens spend their money, it affects people from countries around the world. Madden states, “There are people in other countries who like to do business with online gaming organizations and now their freedom to do so has been blocked because some of these organizations deal with financial institutions or funds transfer services that are based in the US. The US is once again trying to force their will on free people around the world.”

The issue of freedom to participate in online gambling has been evident in the dispute between the US and Antigua. In 2003, Antigua initiated the dispute resolution process of the World Trade Organization (WTO) in order to challenge the total prohibition by the US of cross-border gambling services offered by Antiguan operators. The WTO has ruled in favor of Antigua twice, stating that the US restrictions against online gambling violate an international trade treaty. This is important because the WTO legalizes and legitimizes offshore gaming and it places international pressure on the US to comply with the WTO ruling.

However, in light of the new legislation recently passed in the US, it seems as though they are not planning to comply. It is now more important than ever for online gaming organizations to deal with offshore (not based in the US) financial institutions and funds transfer services. This will make it possible for them to protect their interests and their profit margin. For the US citizen who wants to participate in online gambling, the option of opening an offshore bank account may be viable route to ensuring they can freely spend their money in whatever way they wish.
