Paris Hilton's daddy, Rick Hilton (Hilton & Hyland Real Estate) had something to celebrate on Father's Day this year as he recently won a record case awarding the firm and real estate agent, Chad Rogers. The high profile H&H case involved a real estate commission dispute on an $11.55 million-dollar beach house in the ultra exclusive Malibu Colony, against Susan Loggans for a record deserved commission that went unpaid. Chad Rogers, a prominent real estate agent in Los Angeles, who is often called “baby face Rogers” due to his young looks, was the victim in this long-running court battle with Loggans who took advantage of the young and innocent agent. But regardless of Chad’s boyish looks or astonishing success that attracted Hilton & Hyland to hire him, his impeccable knowledge of real estate, especially in the billionaire beach known as Malibu Colony, paid off when he realized Loggans had no intention of paying commissions to the firm.
"Susan Loggans knows what she did was wrong," said Chad Rogers (real estate agent for Hilton & Hyland). "I stood up to her and won. But the bottom line is that just because people have money it doesn’t mean they are above the law."
On Monday, June 26, 2006, Hilton & Hyland learned that the Honorable Cesar C. Sarmiento of the Los Angeles Superior Court ruled in its favor in granting an award of attorneys’ fees in the amount of $295.486.75 and costs in the amount of $48,537.40 against Susan Loggans, a Chicago attorney, in a hard-fought legal battle that included a nine day trial before a Malibu jury. Judge Sarmiento’s latest rulings in the case increase the total amount of the judgment in favor of Hilton & Hyland and against Ms. Loggans to $746,098.85, including the jury’s award of a commission in the amount $360,937.50, plus prejudgment interest in the amount of $41,137.20.
At the trial of the case, the jury learned that in October 2001, Chad Rogers, who was 24 years old at that time, was originally introduced to Ms. Loggans by Sheldon Adelson, the owner of the Venetian Hotel in Las Vegas, Nevada. As a result of that introduction, Mr. Rogers played a critical role in assisting Ms. Loggans in locating and purchasing her Malibu residence in May 2002 for $5,750,000 and in leasing it during the summer months in 2002, 2003 and 2004 to a variety of well-heeled individuals, such as Lisa Bonder Kerkorian (ex-wife of billionaire Kirk Kerkorian), Fred Rosen and Suzan Hughes. In June 2004, Ms. Loggans decided to sever her professional relationship with Mr. Rogers. A few months later, in October 2004, Ms. Loggans sold her Malibu residence to Bruno and Kyara Mascolo, the founders of TIGI/Bedhead, a hair care products company, for $11,550,000. The dispute arose due to Ms. Loggans’ refusal to pay a commission to Hilton & Hyland and Mr. Rogers under the terms of a one-page, written contract, a Single Party Compensation Agreement, that protected Hilton & Hyland’s and Mr. Rogers’s interests in the event of a sale of Ms. Loggans’ Malibu residence to the Mascolos.
