Ruling Issued in TyMetrix Injunction Request Against SpectoWise

TyMetrix litigation against SpectoWise concludes with a temporary injunction in TyMetrix favor ending on March 14, 2007. SpectoWise is disappointed with the court's ruling but respects it and is pleased that TyMetrix' legal harassment of SpectoWise has come to an end.

Manchester, CT (PRWEB) January 31, 2007 -- CT TyMetrix, Inc., a division of CT Corporation of New York and owned by Wolters-Kluwer N.A. of Amsterdam in the Netherlands, filed an Emergency Temporary Injunction Request in the Connecticut state courts against SpectoWise, Inc. shortly after SpectoWise was founded as a new startup company in October of 2005.

TyMetrix' injunction request alleged a violation of a non-compete and employment agreement, tortuous interference with contract and violation of the Connecticut Uniform Trade Secrets Act on the part of Peter Szymonik, SpectoWise's President and CEO and TyMetrix' former Vice President of Technology Operations. The Connecticut state court denied TyMetrix's application for ex parte relief after a hearing before the Honorable Jane Scholl and the matter was set down for a full evidentiary hearing on the Temporary Restraining Order and Injunction.

In response to the claims by TyMetrix, Inc., Mr. Szymonik and SpectoWise asserted defenses of wrongful discharge and abandonment of the non-compete and employment agreement by TyMetrix, Inc.

Mr. Szymonik also asserted a counterclaim, claiming wrongful discharge, breach of the implied covenant of good faith and fair dealing and a sought a declaratory judgment that as a result of the wrongful discharge by CT TyMetrix Inc., that Mr. Szymonik was excused from any further performance under his non-compete agreement, whose validity was also in question.

A seven day hearing on the temporary injunction was argued before the Honorable Lois Tanzer in February and March of 2006. The court heard evidence on the issues raised by CT TyMetrix, Inc. as well as the issues raised by the defenses of Mr. Szymonik.

In a ruling issued on December 28th, well over a year after CT TyMetrix initially sought their emergency injunction, and nine months after the court hearings, the honorable Judge Tanzer issued a ruling for CT TyMetrix preventing Mr. Szymonik and SpectoWise from offering products and services similar to those provided by CT TyMetrix on March 14, 2005 and for a period one year prior to Mr. Szymonik's his departure from the company, until the expiration of Mr. Szymonik's non-compete on March 14, 2007.
