David H. Perecman, a veteran New York personal injury lawyer, files a novel premises liability law suit against Roxy Nightclub for a stabbing that occurred outside of the nightclub premises.

New York, NY (PRWEB) August 1, 2007 -- David H. Perecman, a veteran New York personal injury lawyer and co-founder of the personal injury law firm of Perecman & Fanning, is bringing a novel premises liability law suit against the Roxy nightclub in New York City for a stabbing that occurred outside of the nightclub premises (Supreme Court Bronx County, Case #21670/01).

Mr. Perecman argues that his client, Jason DeJesus, who attended the Roxy and who was stabbed by another Roxy patron a block and a half outside of the club, was improperly protected by The Beer Garden, Inc., the owner of the Roxy in the City.

According to the suit, the incident occurred when Mr. DeJesus's friend was accosted by another Roxy patron while inside the club. The bouncers then threw both of the people and their friends out of the club, one after the other and from the same door. The perpetrator then gave chase, catching Mr. DeJesus, a block and a half from the club and stabbed him eight times. Mr. DeJesus recovered from his stab wounds but still suffers from psychological trauma and physical pain.

Successfully defeating the defendant's summary judgment motion at trial and on appeal, Mr. Perecman argued that under the unique circumstances of the premises liability case, the defendant should have known that Mr. DeJesus would be harmed when they threw both of the parties out of the club almost simultaneously and out of the same door.

"This is a lack of security case. The premises owner did not take appropriate basic measures to secure their clientele, even if it wasn't on their premises. They did not follow their own rules," says Mr. Perecman.

Cyril Baines of Perecman & Fanning wrote the motion and Mr. Perecman argued the appeal. The case will go to trial in August.
