"FELA" is a federal statute (45 U.S.C. § 51 et. seq. (1908), and stands for "Federal Employers Liability Act." FELA was ratified by Congress in 1908, and its legislative intent was to protect railroad workers who were injured while on the job. FELA gives railroad workers who are not covered by regular workers' compensation laws the ability to rightfully pursue legal claims for their injuries in the form of damages. FELA allows for monetary payouts in the form of damages for pain and suffering as well as medical expenses. Generally, these claims are decided by juries based on comparative negligence rather than a pre-determined benefits schedule under workers' compensation statutes which are common in most states.
