Mesothelioma Patient Recovers $3.5 Million in Settlements in Addition to a $2.6 Million Judgment

However, the insurance company refused to participate in the lawsuit even though it was given ample notice and opportunity to do so.

Steven Patti - a partner in the firm, obtained a default judgment against the inactive corporation in the amount of $2.6 million. Under the laws of both California and Nevada, a direct action suit may be brought against an insurer that refuses to appear and defend its insured. The direct action can result in obtaining the full amount of the default judgment from the insurance company. Clapper, Patti, Schweizer & Mason intend to pursue a direct action against the insurance company on behalf of Mr. Ham.

Malignant mesothelioma is diagnosed in 3,000 Americans a year and is almost 100 percent fatal within 18 months of diagnosis, experts say.
