Fedex Delivery Drivers Contractors or Employees

The law firm of Pulaski & Middleman LLC of Houston launch a web site as a resource for Fedex drivers.

Houston, TX (PRWEB) July 11, 2007 -- In response to the growing controversy that exists between Fedex Ground and its delivery drivers, Pulaski & Middleman, LLC of Houston, Texas has launched a complete Web site, whose URL is http://www.fedexovertimelawsuit.com.

This Web site is intended to serve as a source of information for anyone who may have been or is currently affected by the classification of Fedex delivery drivers as independent contractors as opposed to employees. Pulaski & Middleman, LLC is led by Attorneys Adam Pulaski and David Middleman, and the firm focuses its practice on class and mass action lawsuits.

Fedex Ground is a division of Fedex Corp., and the company has been embroiled in this controversy for more than a year. Specifically, claims that have been filed center on the classification of drivers as independent contractors as opposed to employees, and there are substantial differences between these classifications in terms of tax liability and the responsibility for benefits payments on the part of the drivers in question.

Example case citations include Hart v. FedEx Ground Package System Inc., 457 F.3d 675, 676-77 (7th Cir. 2006) and DENNIS W. BYARS v. FEDEX GROUND PACKAGE SYSTEM, INC., ET AL. (AC 27385)

Different events have led to certain entities gaining the ability to be classified as employees, and one example is the decision of the Boston office of the National Labor Relations Board to classify drivers as employees so that they could hold a vote on whether or not to unionize their local shop.

Since then, other occurrences have taken place, and according to the International Association of Machinists, actions have been filed in 27 states. In general, these actions seek recovery for costs incurred as a result of self-financing insurance and workers' compensation and other general damages associated with being classified as an independent contractor as opposed to an employee.
