According to James, a contributing factor to current sky-high foreclosure rates is the fact that many homeowners simply do not know their options and they wait too long to take action. "Now is the time for negotiating with lenders. New legislation has given banks incentives for working with debtors in default and our programs are designed to fully take advantage of these new options," said James. The Mortgage Forgiveness Debt Relief Act, enacted by Congress in 2007, provides a 3-year window for homeowners to refinance their mortgages without paying taxes on any debt forgiven.
James encourages homeowners who think it is already too late to avoid foreclosure to contact his office. "Even if you have received an auction notice there are still alternatives available to you," he said.
