When a Southwest Airlines jet skidded off the runway in a snowstorm at Midway Airport, it crashed through a barrier and slammed into the family car of Joshua Woods that was on a nearby street.
The six-year-old was singing "Santa Claus is Coming to Town" when he was killed before the eyes of his parents and two brothers, who also were hurt. The family brought a lawsuit in Cook County Circuit Court (Woods v. Southwest Airlines, No. 06 L 3686, 2006) which was removed to federal court (Woods v Southwest Airlines, No. 06 C 2203, N.D.Ill., 2006). The case later settled, but the issue continues to come up in aviation cases.
The issue of where airline cases should be filed is an issue early in aviation litigation. Robert Clifford, nationally renown aviation attorney, examines the issue in an article that appeared in the Chicago Lawyer, "Not All Airline Cases 'Arise Under' Federal Law. To read more,
