About the Cell Phone Laws:
The two laws (Vehicle Code, sections 23123 - 4) will take effect from July 1, 2008. They take effect immediately with no grace period. The DMV explains the first law "... prohibits all drivers from using a handheld wireless telephone while operating a motor vehicle." and the second states, "Motorists 18 and over may use a 'hands-free device'."
While a violation point will not be added for violation of the cellular phone law, the conviction will appear on the driving record. The base fine starts at $20 for a first offense. Subsequent offenses will see a base fine of $50, with additional penalty assessments that may triple the base amount.
The new laws do not prohibit dialing while using a hands-free, but text messaging is discouraged. An officer is allowed to pull a driver over and issue a citation for text messaging while driving. The only exceptions to the laws are in the case of emergencies. A driver is allowed to use a cell phone without a hands-free device to make emergency calls to a law enforcement agency, a medical provider, the fire department, or other emergency services agency.
