Suzuki Sued by Husband Who Lost Wife in Fatal Suzuki Grand Vitara Rollover Accident

Steven Bardonner and his minor children are suing Suzuki Motors Corporation for the wrongful death of his wife, Andrea. Andrea was fatally injured when their Suzuki Grand Vitara rolled over. She died at the scene and her two minor daughters suffered serious and permanent injuries. According to court documents, on July 27, 2006, Andrea Bardonner and her two minor daughters Nichelle and Makayla were in their Suzuki Grand Vitara as they traveled on Highway 16 near Wildwood, Alberta, Canada. The driver suddenly lost control of the vehicle and the Suzuki Grand Vitara rolled over. Andrea Bardonner was ejected through the vehicle's window and died at the scene. Her daughters sustained serious and permanent injuries.

The court documents state that the Suzuki Grand Vitara had insufficient lateral and roll stability that allowed it to rollover. In addition, although Andrea was properly seat belted at the time of the crash, her seat belt failed, causing her to be ejected from the vehicle's window, according to court documents.

In their lawsuit, the Bardonners are asking for economic damages including medical expenses; loss of past earnings and future earning capacity; funeral and burial expenses; and damages for wrongful death, personal injuries and pain and suffering.

"The callousness of automakers like Suzuki is unbelievable, to have knowingly manufactured a seatbelt that tears," said Brian Chase, partner at Bisnar Chase."For less than $100 more in production costs, this Suzuki Grand Vitara would be a safer car, a wife and mother would be alive today and her two daughters would not have been seriously injured."
