The Employee Free Choice Act (EFCA) is the most significant piece of proposed employment legislation since the Civil Rights Act of 1991. If enacted, EFCA would effectively take away the right of employees to vote on union representation in a National Labor Relations Board supervised secret-ballot election, substituting a system in which the important issue of union representation is decided by a majority card count. In contrast to elections held under current Federal law, in place since 1935, there would be no pre-election period to provide employees the opportunity to learn the facts about union representation.
