Los Angeles, Calif. (PRWEB) February 7, 2009
The Georgia Peach Corporation dba as Sugar Plum Fairy Baking Company located in Gardena, California, and its owner Stacy Aaronson have been sued for non-payment of overtime wages and other Labor Code violations. This is the second lawsuit filed against defendants alleging that they do not pay proper wages to their employees, majority of whom are Hispanic. The First lawsuit was filed in Los Angeles County, under case number BC366533.
The lawsuit alleges that defendants had devised a plan whereby they would pay their employees with two checks. It is alleged in the Complaint that one of the checks would cover all the hours worked up to 40 hours and had the proper deductions as mandated by State and Federal law applied to it, the second check which had no deductions would cover any hours worked over 40 hours a week. According to Plaintiffs the second check would pay the employees "straight" time as opposed the mandated time and half for over time. The new lawsuit which has also been filed in Los Angeles Superior Court under case number BC401661, further alleges that defendants did not provide the required meal and rest breaks to employees and violated other Labor Code Sections as well.
