With new technology and greater sophistication among creative talent, opportunities for self-determination and control exist today that never existed before.

Matthews Wilson Hunter, LLP, under the direction of named partner Donald K. Wilson, Jr., announces that it has expanded its intellectual property practice to specifically counsel authors (and/or their heirs) how to terminate certain copyright transfers and recapture pre-1978 copyrights.
"Several authors and songwriters may now have the opportunity to fully reap the benefits of their talents which may have been missed due to a lack of proper representation or certain other circumstances many years ago," said Wilson. Wilson further stated, "With new technology and greater sophistication among creative talent, opportunities for self-determination and control exist today that never existed before."
Section 304(c) of the copyright Act allows the author, or his/her heirs, in the event the author is deceased, to terminate pre-1978 transfers of copyrights and recapture such rights. This can provide tremendous opportunities for authors or their heirs to increase their income derived from such copyrights. But such termination must be done within the strict time frame and guidelines set forth in the Copyright Act.
Matthews Wilson Hunter, LLP will not only assist in the recapturing of copyrights, but also advise and counsel clients on the best way to commercially exploit and administer those recaptured rights. "Depending on the client, their level of desired involvement in the entertainment industry, age and financial resources, we will work with the client to determine whether self administration, administration deal, co-publishing agreement or sale is the best choice," says Wilson.
Matthews Wilson Hunter, LLP is a California law firm with offices in Los Angeles, California and Frankfurt, Germany and affiliated offices in Washington, D.C.
