Grieving Father Antonio Balta Could be Freed Under Florida 2007 Law HB667

The Committee to Free Antonio Balta asks for the release of Antonio Balta, a grieving father, age 32, now into his fifth year of imprisonment for the unintentional death of his baby daughter, who died of heat stroke, on a cool day, in the back seat of the family car. Originally from Peru, he was sentenced to 20 years in prison, when other parents who have done the same go free, making him the only father in America to receive so severe a sentence. Now, based on the 2007 Florida law HB667, which limits maximum sentences to 5 years, Antonio Balta should now be freed, since he has already served 5 years of his 20 year sentence.

Case Information:
Antonio Francisco Balta was sentenced on March 21, 2005, in the Florida Broward County Court, Case Number 04004406CF10A. He received 20 years with no parole, and will be deported to Peru when his 20 year sentence is ended. Considering that other fathers who have done exactly the same receive no punishment at all, or just probation, this is a particularly harsh sentence. Now, a 2007 Florida Law HB667, authored by Florida Representative Joe Gibbons, states that no parent can receive more than 5 years in prison for the same circumstance. The Committee to Free Antonio Balta feels that since Mr. Balta has already served five years as a model prisoner, that he should be released to return to Peru now, and save the state of Florida $300,000 to $400,000. Mr. Balta wants to return to his native country of Peru.
