Several important changes were made to the I-9 form and the rules controlling which documents an employer can accept to prove work authorization. The most notable change is that all documents presented by employees must be valid and unexpired. Previously, employers could accept certain expired documents to establish identity, including an expired U.S. passport or driver's license. In implementing this new I-9 rule, the government noted that expired documents are prone to fraudulent (counterfeiting) use and newer documents are more likely to contain security features which make them less vulnerable." One of the most crucial aspects of the new form and I-9 rule is the timing: the revised I-9 form is now the only version of the form which can be used to satisfy the employment eligibility verification requirements for all new hires and reverifications going forward.
