USITC Files Trademark Opposition Against British National
A leading U.S. cosmetics company battles Trademark Infringement against British National.
Las Vegas, NV (PRWEB) June 22, 2009 -- U.S. International Trading Corp. (USITC), a Nevada-based natural cosmetics manufacturer and distributor of popular brands: Millcreek Botanicals, Amazon Organics, DuBarry, Bellance and Silver Fox, has filed an opposition statement with the United Kingdom's Trademark Office, South wells. The statement charges that Application no. 2458259, submitted by self-proclaimed English businessman, Michael Miller of Brighton, is a direct trademark infringement on USITC's DuBarry cosmetics line (no. 182923), owned by the company since the late 1990s.
"This is a shameless act," said Panch Prasad, USITC Chief Executive Officer. "USITC has worked hard through the years to maintain the first American Cosmetic elegant. DuBarry was established in 1903 by founder, Richard Hudnut. To have someone literally try to steal the brand that I've owned since 1997 by filing a trademark application is baffling to me."
In his statement of opposition, Prasad outlines to the U.K. trademark office that Miller's filing for the DuBarry name is the latest in a long run of questionable practices by the British national. In 2007, Miller contacted Prasad about a possible business relationship regarding the expanded distribution of the DuBarry line in England. After repeated attempts to get Miller to sign a confidentiality agreement, Miller finally did, but only after altering the document in ways to limit USITC's rights under the agreement.
Miller also went on to act against USITC by registering Website domains with the DuBarry name while also registering the "DuBarry Perfumery Company Limited" name as a U.K. company without Prasad's permission. After a firm warning from Prasad's U.S. lawyer, Joseph Nabor, of Fitch Even Tabin & Flannery, Miller still continued with his alleged unauthorized registration practices. Prasad has also contacted the U.S. Department of Commerce, which, through its Website www.stopfakes.com, helps businessmen protect their intellectual property, of the matter.
"I consider this a great lesson for the business community as a whole. As established companies consider the opportunity of globalizing sales and operations, the protection of one's trademarks and copyrights is of utmost importance," the executive added.
Prasad is not only well known in the natural health industry for his popular brands; but he has also become a voice for U.S. business owners looking to export products around the globe. He is a designated member by Secretary of Commerce to the U.S. Export Council Nevada District to contribute his leadership and business experience in support of the U.S. Government Export expansion effort and is also on the Executive advisory board member for the University of Nevada, Las Vegas College of Business, International Trade.
