Mainstream Advertising Takes the Bull by the Horns and Files a Complaint against the Operators of Bullhorn Marketing LLC
In a complaint filed by Mainstream attorneys on October 9, 2009 in the Superior court of the state of California in and for the county of Los Angeles, Mainstream Inc. alleges that Collin Kay, Nathan Barnett and their newly formed companies acted in violation of an Employee Agreement signed upon their commencement with Mainstream and as a result have caused economic harm to Mainstream Inc. The two are being sued for punitive and economic damages.
Woodland Hills, CA (PRWEB) October 22, 2009 -- Mainstream Advertising Inc. an online marketing company headquartered in Woodland Hills, Ca. has filed a complaint in Los Angeles Superior Court against Bullhorn Marketing LLC and its two creators Collin Kay and Nathan Barnett, for allegedly stealing Mainstream trade secrets, business contact information and other intellectual property. Collin Kay and Nathan Barnett, former Mainstream employees who left the company in early 2009, are listed as co-conspirators in the legal action, case number BC423165.
In the complaint filed October 9, 2009, Mainstream claims to have proof that Barnett and Kay have been contacting Mainstream clients and working direct deals with them since they left the company and formed Bullhorn Marketing LLC, in February of 2009. According to Mainstream attorney Kris Thompson, Kay and Barnett are acting in violation of the Mainstream Employment Proprietary Agreement they signed and agreed to when they commenced work with the company. Kay and Barnett have yet to admit to the allegations made by Mainstream.
Mainstream sent letters and made phone calls to both Kay and Barnett after they left the company reminding them of their obligations to Mainstream under their employee agreement, according to Director of Human Resources Michelle Frenkel.
"Mainstream Advertising is taking the prosecution extremely seriously. We have reason to believe that a large amount of highly confidential information was taken and if so this information would give Bullhorn Marketing LLC an unfair advantage in the market place. Mainstream has spent the past 13 years developing superior technology and forming relationships within the industry at an expense of millions of dollars in order to secure a competitive edge in the marketplace. If we allow former employees to act unethically and immorally we would not only harm Mainstream as a company but the industry as well. The amount of intellectual property that we have reason to believe was stolen requires immediate action on our part and we want to make it known that these actions will not be ignored and will be prosecuted to the fullest extent of the law," said Mainstream's Director of Intellectual Property Policy and Enforcement Shawn O'Neal.
"We urge anyone who has borrowed, used or stolen intellectual property from Mainstream Advertising Inc. to refrain from doing so in the future and to remove any of said data from any public forum," said O'Neal.
Mainstream is seeking full punitive and economic damages from Barnett and Kay as well as reasonable attorney fees, as stated in the pending complaint. "It is our hope that the judge will grant a preliminary injunction on Bullhorn Marketing until this matter is resolved," said O'Neal.
Mainstream Advertising Inc. provides result-based interactive online marketing services to advertisers and agencies. Their extensive advertising network consists of inventory that they purchase from Web Traffic, Search Engine Optimization, PPC campaigns and email publishers. Mainstream Advertising Inc. runs major campaigns on third party web sites like Yahoo, MSN and Google and reaches 85% of the online audience.
