The owner of the property and the cleaning company initially denied the claim alleging that the plaintiff saw the defendant's employee with a mop in hand, had ignored the caution sign and had insufficient symptoms to support a diagnosis of this crippling disease.
After years of litigation and countless depositions regarding liability and the diagnosis of CRPS, the case was scheduled for trial. Approximately 30 days before the case was to be determined by a jury in West Palm Beach, the defendant agreed to a significant, confidential settlement.
The plaintiff will now be able to offset her diminished earning ability with the interest to be earned on the settlement proceeds and will have the funds necessary to obtain continuing medical care.
