In the ongoing arbitration between the Four Seasons hotel management company vs the owner of the 200-acre resort situated in the community of Aviara in South Carlsbad CA, Broadreach Capitol Partners/Maritz, Wolff and Co., continues to stir speculation on various levels. Embroiled in a legal dispute since April of 2009, the two combatants, it would seem, have not yet reached a resolution or at least have not made one publicly known.
In a press release dated May 13th, 2009 the Four Seasons stated “Under the terms of the existing contract with the Owners, Four Seasons has the legal right to manage Four Seasons Resort Aviara until 2087. The management agreement requires that any and all disputes that arise be handled through arbitration. Four Seasons has fully complied with the Owners’ original request to take the dispute to arbitration, and will respect and honor its contractual obligations and the arbitration process.
Four Seasons will remain the manager of the property unless, and until, the arbitration process determines differently. Thus, statements made by the Owners’ lawyers that Four Seasons has been terminated and is trespassing are categorically untrue.”
Neither the Four Seasons nor Broadreach Capitol have made further public comment regarding the matter in recent months.

Four Seasons, a privately held company, who’s owners include Microsoft’s Bill Gates, Prince Al-Waleed bin Talal and Four Seasons founder Isadore Sharp, is a hotel management company that manages some of the most exquisite properties around the world.
Broadreach Capitol Partners, established in 2002, is a real estate investment company with investments of over $2.8 billion.
Caught in the middle, among others, are the three thousand plus timeshare owners who have purchased second home interests at the resort over the past decade plus. The 132-timeshare villas at Four Seasons Aviara are located in two separate villages surrounding the 5-diamond awards hotel. Divided into 52 1-week increments, sales of the timeshares began in 1997 and are drawing to a close as inventory has been consumed.
