Dansker & Aspromonte Associates, the New York City-based personal injury law firm, today announced a settlement in Queens Supreme court. The settlement reached was in favor of a plaintiff injured in a 20-foot fall from a ladder in 2007 in Scarsdale, NY (Case no. 11511/07).
The plaintiff fell off of an unsecured ladder while installing crown molding at the top of a second-story room. The ladder slipped from beneath him, causing him to fall, sustaining injuries to his face, head, knee, mouth and shoulder.
The case, which was overseen by Judge Martin J. Schulman, found that the plaintiff was not provided tools or devices to prevent the fall, including a harness or security line, a violation of Labor Law § 240(1). The ruling also found that the site was not safeguarded properly by the premises’ owner, as required by Labor Law § 241(6).
Douglas E. Hoffer, an attorney at Dansker & Aspromonte Associates, represented the plaintiff. “Although our client underwent several surgeries and suffers from residual injuries, we are pleased that the judge helped to convey the message that organizations must obey the law. That includes providing a safe working environment for contractors and employees,” Hoffer said.
